A deposit of $5,000 per lot, or $20,000 total if sold as an entirety, in the form of certified check, cashier’s check or money order, at the time of sale will be required of all purchasers other than the holder of the Deed of Trust or an affiliate. The deposit(s) must be increased to 10% of the purchase price within 2 business days at the office of the auctioneer. The property and improvements, if any, will be sold in an “AS IS” condition and subject to conditions, restrictions, existing building, zoning, and/or environmental violations, agreements of record affecting the same, if any, and with no warranty either expressed or implied as to the description of the condition of the property or improvements.
Manner of Sale
Each lot described above will be offered for sale, individually, with the high bids being reserved. Then the lots will be offered for sale as an entirety. The greater of the bids for the lots, individually, or the bid for the lots in the aggregate, will be accepted. Notwithstanding the aforementioned, the Substitute Trustees reserve the right to determine or change, in their sole discretion, the manner in which the units are offered and sold.
